The HSE has confirmed that proposals to begin charging businesses for help and advice
following a HSE prosecution will come into effect from April 2012. These proposals
have come about because of Government cutbacks and therefore, the need for the HSE
to become self-funding. The hourly rate – which has now been decreased to £124 per
hour from the initial estimate of £133 – is a matter of concern for businesses operating
in the current economic climate, particularly SMEs.
The scheme, known as ‘fee for
intervention’ (FFI) means businesses found to have broken health and safety laws
will pay the costs incurred by HSE in helping them to put matters right. For the
first time, the changes place a duty on the HSE to recover the costs of their interventions
in certain circumstances. Costs will be recovered if a material breach – a failure
to adhere to health and safety law identified by an inspector as requiring formal
action – is discovered during an inspection or investigation. Fees would apply from
when a letter or e-mail recording the duty-holder’s breach is sent up to the point
where the HSE’s intervention in supporting businesses in putting matters right has
concluded.
